No White House or leading lawmaker of either party has seriously entertained deporting 11 million illegal immigrants now in the U.S. Presidents Barack Obama and Donald Trump both used discretion and triage in deciding which illegal immigrants to target for deportation. Some of the immigration slots under the visa lottery program would be used for all people in the the USA who have lost their temporary protected status, and some would be used for people from low-immigration countries.

Of course, the entire reason the senators asked Kelly for the White House's demands in December was that they hadn't taken the October wish list seriously.

The proposal presented by the bipartisan Gang of Six was a path to citizenship for undocumented immigrants who came to the United States as children - beyond just those who were enrolled in DACA when it ended, according to lawmakers and sources familiar with the meeting.

A Justice Department spokesman was widely quoted in the press saying that the agency will continue to "vigorously defend" its position that DACA was "was an unlawful circumvention of Congress" and that the government "acted within its lawful authority in deciding to wind down DACA in an orderly manner".

The order by U.S. District Judge William Alsup issued late Tuesday says safeguards against deportation must remain in place for the almost 690,000 immigrants in the Deferred Action for Childhood Arrivals program while a legal challenge to ending the Obama-era program proceeds.

Republican leaders distanced themselves from the bipartisan group. "I'm not negotiating with Sen". John Cornyn of Texas, the GOP whip, as he headed toward the session.

Cornyn told reporters any deal needs support from more than the six senators who comprised the bipartisan group.
