Wesley Mathews Indicted on Capital Murder Charge

We still don't know exactly how Sherin Mathews died. Wesley Mathews admitted to police that he'd moved his daughter's body but said that she'd died after choking on milk in the family's garage.

Authorities were tight-lipped at a news conference Friday, saying they did not want to prejudice a jury and were continuing to investigate.

District Attorney Faith Johnson said evidence in the case was still unfolding Friday, but that there was no indication anyone else was involved in the death. "We will be seeking justice on her behalf".

An attorney for Sini Mathews has previously said she played no role in Sherin's death. Prosecutors said the murder charge, which could carry the death penalty, was filed after an autopsy determined the girl died from "homicidal violence".

Mathews had already been charged with felony injury to a child. He was also indicted Friday for tampering with evidence, KXAS-TV reported. That stems from the couple's decision to leave the girl at home on October 6 while they went out to dinner with their biological child, according to the indictment.

When Dakil reported her findings to Sini Mathews, the mother said she disagreed with the findings and told the pediatrician that a report to Child Protective Services would "ruin her weekend", Dakil said. Wesley initially told authorities he left her outside in the middle of the night as punishment for not drinking her milk and that when he returned, she was gone.

"That is absurd right there and then to come back after the body is found and walk into the police department with your lawyer and sit down for a voluntary interview and give a completely different story".

Wesley Mathews was jailed on $1 million bond last fall.

Despite the limited details about what actually happened to Sherin, Johnson said she's confident her team will be able get justice.
